In our trademark practice we notice that many trademark owners receive emails from China, warning them about a conflicting trademark or domain name that would violate their rights.
If you do not have any activities and/or do not own any trademark rights in China:
Then you can delete the email.
Trademark rights in the EU do not provide you any rights in China, and the first one to file in China, holds the prior rights.
Action without prior registration is only possible in exceptional cases, for example in the case of a well-known trademark or bad faith.
If you have any interest in or own any trademark rights in China:
Then please contact us.
We will advise you whether action against the Chinese trademark or domain name is necessary and feasible.
